Introduction

These Terms of Service ("Terms") govern your access to and use of our AI Phonk Maker app and services. By using the service, you agree to these Terms.

Accounts

  • You must provide accurate information and keep your account secure
  • You are responsible for all activity under your account
  • You can delete your account at any time from Settings > Delete Account in the App
  • Account deletion is permanent and cannot be undone
  • Deleting your account does not automatically cancel your Apple subscription — you must cancel it separately in App Store settings
  • We may suspend or terminate accounts that violate these Terms

Acceptable Use Policy / AIGC Content Standards

You may use the service only for lawful purposes. When submitting prompts, uploading audio, or generating AI content (AIGC), you must not create, request, upload, distribute, or attempt to generate any of the following:

  1. Sexual / Adult content — Pornographic, sexually explicit, or obscene material
  2. Violence / Gore — Graphic violence, gore, or content that glorifies severe harm
  3. Hate speech — Content that promotes hatred, discrimination, or violence against individuals or groups based on protected characteristics
  4. Child sexual exploitation and abuse (CSAM) — Any sexual or exploitative content involving minors (anyone under 18), including fictional depictions. We have zero tolerance for this category
  5. Deepfakes / Impersonation — Content that realistically imitates a real person's voice, likeness, or identity without authorization, or that is intended to deceive others about a person's identity
  6. Copyright / Trademark infringement — Content that infringes copyrights, trademarks, or other intellectual property rights (including generating covers or clones of protected works without appropriate rights)

You also must not:

  • Use the service to break applicable laws or distribute harmful content
  • Attempt to reverse engineer, disrupt, or impair the service
  • Violate others' rights or privacy
  • Circumvent safety filters, rate limits, or other protective measures
  • Abuse signup bonuses by creating multiple accounts, using device spoofing, or other fraudulent methods

Enforcement for Violations

If you violate this Acceptable Use Policy or these Terms, we may take one or more of the following actions, depending on severity and history:

  • Remove or disable access to the offending content
  • Warn you and require corrective action
  • Temporarily suspend your account or generation privileges
  • Permanently terminate your account
  • Report illegal activity to law enforcement or relevant authorities where required or appropriate
  • Refuse refunds related to misuse

Content Review Process

After receiving a report, we generally:

  1. Acknowledge receipt of the report
  2. Review the reported content and related account activity
  3. Take enforcement action when a violation is confirmed
  4. Preserve evidence and escalate to authorities when legally required (especially for CSAM or other serious illegal content)

AI Technology Disclosure

Music generation on our platform is powered by the Suno API (via Kie.ai). Your prompts, lyrics, and generation parameters are sent to Kie.ai/Suno to generate music. We may update or change underlying providers or models over time; when we do, we will update this disclosure to keep it accurate.

By using the Service, you acknowledge that:

  • Your prompts, lyrics, and generation parameters will be transmitted to third-party AI providers (Kie.ai/Suno) for processing
  • These providers may retain your data according to their own terms and retention policies
  • Generated content is private by default on the iOS App

Content and Ownership

Your Inputs and Outputs: You retain rights to the content you input and the songs generated, subject to applicable law and provider terms. You grant us a limited license to process content to operate and improve the service.

Our Content: All site materials, trademarks, and software are owned by us or our licensors and are protected by law. Do not copy or reuse without permission unless expressly allowed.

AI-Generated Songs

  • Song outputs may be inaccurate, incomplete, or may inadvertently resemble existing copyrighted works
  • Use your own judgment and verify originality before using generated songs commercially
  • You are responsible for how you use generated musical content
  • We do not guarantee that generated songs are free from copyright infringement
  • Outputs remain subject to the Acceptable Use Policy above and to Suno's applicable terms and policies
  • On the iOS App, all generated songs are private by default and not shared publicly

Privacy

Your prompts, lyrics, and generation parameters are sent to Kie.ai/Suno for music generation. Our Privacy Policy describes in detail how we collect, use, and protect your information, including data retention periods and your rights.

Plans, Payments, and Refunds

  • Some features require payment. Prices and features may change
  • Subscriptions are processed through Apple App Store and managed by RevenueCat
  • Payments are processed by third-party providers. Taxes may apply
  • Unless stated otherwise, subscriptions renew automatically until canceled
  • You can manage your subscription and cancel at any time at https://apps.apple.com/account/subscriptions
  • Deleting your account does NOT cancel your Apple subscription — you must cancel separately
  • If you haven't used your subscription within one week of purchase, you may request a refund by contacting our support team
  • Signup bonus credits are awarded once per user. Abuse of the signup bonus system (creating multiple accounts, device spoofing) will result in forfeiture of credits and may result in account termination

Third-Party Services

The service integrates with third-party tools, including:

  • Kie.ai / Suno API for AI music generation
  • Apple Sign in with Apple for authentication
  • Google OAuth for authentication
  • RevenueCat for in-app purchase and subscription management
  • Apple DeviceCheck for anti-abuse verification

We are not responsible for third-party content, terms, or policies, except as required by applicable law. Your use of generated outputs may also be subject to the third-party provider's terms.

Disclaimers

  • The service is provided "as is" without warranties of any kind
  • We do not guarantee error-free or uninterrupted operation
  • We do not guarantee that generated songs are original or free from copyright infringement

Limitation of Liability

To the maximum extent permitted by law, we and our suppliers will not be liable for indirect, incidental, special, or consequential damages, or any loss of profits or data.

Indemnification

You agree to indemnify and hold us harmless from claims arising out of your use of the service or violation of these Terms.

Termination

  • You may stop using the service at any time
  • You may delete your account from Settings > Delete Account
  • We may suspend or terminate access if you violate these Terms or for security/legal reasons

Changes to These Terms

We may update these Terms from time to time. Continued use of the service after changes means you accept the updated Terms.

Governing Law

These Terms will be governed by the laws applicable in our primary place of business, without regard to conflict of law rules.
